These Terms of Use (“Terms”) govern your use of the website www.apricoty.com (the “Site”), operated by Apricoty, Inc. (“Apricoty,” “we,” “us,” or “our”), a California company based in Altadena, California, offering handcrafted, all-natural personal care and home goods. By accessing or using the Site, including browsing our shop, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Our Privacy Policy explains how we handle information collected through the Site and is incorporated into these Terms by reference.
2. Changes to These Terms
We may update these Terms at any time by posting a revised version on this page with a new effective date. Your continued use of the Site after changes are posted means you accept the updated Terms. The effective date at the top of this page shows the current version.
3. Use of the Site; Eligibility
The Site is provided for your lawful personal use. By using the Site, you represent that you are at least 18 years old, or that you are using the Site with the supervision of a parent or legal guardian. To place an order, you must be able to form a legally binding contract.
4. Accounts
You may create an account on the Site to make ordering easier. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to provide accurate and current information when creating an account and to update it as needed. We may suspend or close accounts that violate these Terms. Notify us promptly if you believe your account has been accessed without authorization.
5. Products, Orders, and Payment
The following terms apply to purchases made through our online shop:
- All orders are subject to acceptance by us and to product availability. Because our products are handcrafted in small batches, availability can change quickly. We may refuse or cancel any order, including because of a pricing or typographical error, suspected fraud, or stock limitations. If we cancel an order after you have been charged, we will refund the amount charged.
- Prices, products, and promotions (including any free-shipping thresholds) may change at any time without notice.
- Payment is processed by a third-party payment processor. We do not store your full payment card number. Your use of the payment processor is also subject to its own terms and privacy policy.
- Risk of loss passes to you when we deliver your order to the carrier. Shipping and delivery timeframes are estimates, not guarantees.
- Because our products are handcrafted from natural ingredients, color, scent, and appearance may vary between batches. Such variation is a natural feature of the products and is not a defect.
6. Returns and Refunds
Returns and refunds are governed by the policy posted on the Site at the time of your purchase. If you have a question or concern about an order, contact us through the Site and we will work with you to resolve it.
7. Product Information; Not Medical Advice
Our soaps, skincare, and other personal care products are cosmetic products. Information on the Site about our products and their ingredients is provided for general information only. It is not medical advice, and our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Results vary from person to person, and customer reviews reflect individual experiences, not promises of outcome.
Natural ingredients can still cause reactions in some people. Please review each product’s ingredient list before use, especially if you have allergies or sensitivities. We recommend testing a new topical product on a small area of skin first, and discontinuing use if irritation occurs. Consult a physician before using any product if you are pregnant, nursing, have a medical condition, or have known skin sensitivities.

All content on the Site — including text, product photographs, images, graphics, logos, product names, and the design and arrangement of the Site — is owned by or licensed to Apricoty and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-transferable license to view the Site for your personal use. You may not copy, reproduce, republish, scrape, distribute, or use any Site content for commercial purposes without our prior written permission.

You agree that you will not:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to the Site, other users’ accounts, our servers, or any connected systems, or probe or test their vulnerability;
- Use robots, scrapers, or other automated means to access or harvest content or data from the Site;
- Interfere with or disrupt the operation of the Site or the ability of others to use it;
- Impersonate any person or misrepresent your affiliation with any person or entity; or
- Upload or transmit viruses or any other malicious code.

We work to keep the Site accurate and current, but we do not warrant that any content on the Site — including product descriptions, ingredient information, pricing, availability, shipping information, or blog content — is complete, current, or error-free. Content may change without notice.
11. Disclaimer of Warranties
THE SITE AND ALL CONTENT MADE AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. THIS SECTION APPLIES TO THE SITE ITSELF AND DOES NOT LIMIT ANY NON-WAIVABLE WARRANTY OR CONSUMER RIGHT THAT APPLIES TO PRODUCTS YOU PURCHASE UNDER CALIFORNIA LAW. 12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, APRICOTY, INC. AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US THROUGH THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU; IN THAT CASE, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. NOTHING IN THIS SECTION LIMITS ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
13. Indemnification
You agree to defend, indemnify, and hold harmless Apricoty, Inc. and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.
14. Third-Party Links and Services
The Site links to and relies on third-party websites and services, including our social media pages (Instagram, Facebook, and X), Google reviews, fundraising pages, and our payment processor. We do not control these third parties and are not responsible for their content, availability, or their privacy and business practices. Your use of third-party sites and services is at your own risk and subject to their own terms and policies.
15. Termination
We may suspend or terminate your access to the Site or your account at any time, without notice, for conduct that we believe violates these Terms, is unlawful, or is harmful to us or to others. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive termination.
16. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.
17. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. We may assign these Terms; you may not assign them without our written consent.
